A Jackson County jury on Tuesday convicted a Kansas City man of child sex offenses with a 10-year-old girl and the jury recommended a prison sentence of life, plus more, Jackson County Prosecutor Jean Peters Baker announced today.
Adalberto Gaitan, dob: 11/24/1984, was convicted of two counts of Statutory Rape 1st Degree, two counts of Statutory Sodomy and Statutory Sodomy 1st Degree.*
The jury recommended prison sentences of Life and 25 years on the Statutory Rape convictions and 1 and 20 years on the Statutory Sodomy convictions, plus 10 years for the final charge of Statutory Sodomy 1st Degree.
A Jackson County judge will sentence the defendant on Aug. 31, 2021.
According to court records, the crimes occurred in an Independence residence after state Children's Division workers were alerted by a hotline call alleging sexual abuse involving the 10-year-old girl. The Child Protection Center interviewed the girl who told them the defendant had done "awful things" to her. The abuse began when she was 8 or 9 she told CPC interviewers. The child's mother was working long hours and was often away from the residence during that time, when the defendant was home with the children.
Assistant Prosecutors Jamie Hunt and Lauren Berry prosecuted the case on behalf of the state of Missouri.
